These Terms & Conditions govern your access to and use of the HourBridge Health website and the information, tools, and forms we make available through it (together, the site). The site is operated by HourBridge Health LLC, a Delaware limited liability company (hereinafter known as "HourBridge Health," "we," "us," or "our"). Please read these terms carefully. By accessing or using the site, you agree to be bound by them.
These terms cover your use of our website. The locum tenens services themselves (placements, assignments, rates, and credentialing) are governed by the separate written agreements you sign with us, not by this page.
Agreement to these terms
By accessing, browsing, submitting information through, or otherwise using the site, you confirm that you have read, understood, and agree to be bound by these terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the site. If you use the site on behalf of a hospital, clinic, practice, or other organization, you represent that you are authorized to accept these terms on its behalf, and "you" includes that organization.
About HourBridge Health and this site
HourBridge Health is a locum tenens staffing agency. We connect physicians and other healthcare professionals (clinicians) with hospitals, clinics, and healthcare organizations (facilities) that need temporary clinical coverage. The site is an informational and contact platform: it describes our services, lets clinicians submit a CV or express interest, and lets facilities request coverage. We are a staffing intermediary, not a healthcare provider; we do not practice medicine, direct clinical care, or control the services any clinician delivers at a facility.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the site. The site is intended for users located in the United States, and we make no representation that it is appropriate or available for use in other locations.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the "Effective date" above and post the updated terms on this page. Changes apply going forward from the date they are posted. Your continued use of the site after we post changes means you accept the revised terms, so please check back periodically.
Use of the site
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the site for your own personal, non-commercial use or, if you are a facility, to evaluate and request our staffing services. We may change, suspend, or discontinue any part of the site at any time without notice. All rights not expressly granted to you are reserved by us.
Acceptable use
You agree not to:
- use the site for any unlawful, fraudulent, or harmful purpose, or in violation of these terms;
- submit information that is false, misleading, or not yours to share;
- copy, scrape, harvest, or systematically collect content or data from the site, including by bots or automated means, except for standard search-engine indexing;
- attempt to gain unauthorized access to the site or any connected systems, or interfere with their security or operation;
- upload any virus or harmful code, or transmit unsolicited or unauthorized advertising;
- reverse engineer or attempt to derive the source code of any part of the site; or
- use the site in any way that infringes the rights of others or that could damage, disable, or impair it.
Information you submit
The site lets you submit information through forms, such as a CV, professional and licensure details, contact information, or a coverage request (submissions). You are responsible for the accuracy and completeness of your submissions, and you represent that you have the right to share them and that doing so does not violate any obligation you owe to a third party. By making a submission, you authorize us to use it to provide and improve our services, including, for clinicians, presenting your qualifications to facilities, and for facilities, matching you with clinicians. Please do not submit information you consider confidential or are not permitted to disclose. We handle the information you submit as described in our Privacy Policy.
The staffing relationship is governed by separate agreements
The site does not by itself create any placement, employment, agency, partnership, or contractual relationship between you and HourBridge Health, or between a clinician and a facility. Any locum tenens engagement (including assignment terms, compensation, schedules, credentialing, and the parties' respective obligations) is governed exclusively by the separate written agreements executed for that engagement. Nothing on the site is an offer of employment, an offer of an assignment, or a guarantee that any placement, assignment, or coverage will be made or filled.
No professional advice
Content on the site is provided for general informational purposes only and is not medical, legal, tax, financial, or professional career advice, and should not be relied on as such. Clinicians are solely responsible for their own licensure, credentialing, and clinical decisions. Facilities are solely responsible for verifying that any clinician they engage is appropriately licensed, credentialed, and qualified for the role, and for supervising the clinical services performed.
Communications consent
When you provide your contact information through the site, you agree that we and our representatives may contact you about our services by email, telephone, and text/SMS message (including by automated dialing technology) at the email address and phone number you provide. Message and data rates may apply and message frequency varies. Consent to receive marketing calls or texts is not a condition of using our services. You can opt out of marketing emails using the unsubscribe link in any message, and stop text messages by replying STOP. You also agree to receive certain communications electronically and that electronic communications satisfy any legal requirement that they be in writing.
Intellectual property
The site and its content (including text, graphics, logos, the HourBridge Health name and marks, page design, and the selection and arrangement of all of it) are owned by HourBridge Health or its licensors and are protected by U.S. and international intellectual-property laws. Except for the limited license above, we grant you no right or license to our content or trademarks. You may not use our name, logo, or marks without our prior written permission.
Third-party links and content
The site may contain links to third-party websites or resources that we do not own or control. We provide these links for convenience only and are not responsible for the content, products, services, or privacy practices of any third-party site. Your use of any third-party site is at your own risk and subject to that site's own terms.
Privacy
Our Privacy Policy explains how we collect, use, and protect the information you provide through the site. By using the site, you also agree to our Privacy Policy.
Disclaimers
The site is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, that any information on it is accurate, complete, or current, or that it is free of viruses or other harmful components. Any reliance you place on the site is at your own risk.
Limitation of liability
To the fullest extent permitted by law, HourBridge Health and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or related to your use of (or inability to use) the site, even if we have been advised of the possibility of such damages. To the extent any liability cannot be disclaimed, our total liability for all claims relating to the site will not exceed one hundred U.S. dollars ($100).
These limits do not apply to any liability that cannot be limited under applicable law, and they do not change the rights and obligations set out in the separate staffing agreements described in Section 8.
Indemnification
You agree to indemnify and hold harmless HourBridge Health and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the site, your submissions, or your breach of these terms or of any law or third-party right.
Governing law
These terms, and any dispute arising out of or relating to them or the site, are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and, to the extent applicable, by the laws of the United States.
Dispute resolution and arbitration
Please contact us first. Most concerns can be resolved informally. Before starting any formal proceeding, you agree to contact us at info@hourbridgehealth.com and give us 30 days to resolve the issue.
If we cannot resolve it, you and HourBridge Health agree that any dispute arising out of or relating to these terms or the site will be resolved by final and binding arbitration before a nationally recognized arbitration provider, on an individual basis. To the extent permitted by law, you and HourBridge Health waive any right to a jury trial and any right to bring or participate in a class, collective, or representative action. Either party may still bring an individual claim in small-claims court or seek injunctive relief to protect its intellectual property. Any arbitration or permitted court proceeding will take place in Delaware.
General terms
These terms, together with our Privacy Policy and any agreements expressly referenced here, are the entire agreement between you and HourBridge Health regarding the site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These terms create no third-party beneficiaries, section headings are for convenience only, and we are not liable for any failure or delay caused by events beyond our reasonable control.
Suspension and termination
We may suspend or terminate your access to the site at any time, with or without notice, including if we believe you have violated these terms. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution) will survive.
